Data Privacy in Switzerland: Risk-Free Tracking
Since the introduction of the new Federal Act on Data Protection (nFADP) in Switzerland, stricter rules apply to the processing of user data. Google Analytics can still be used, but it requires correct configuration to protect your customers' privacy.
Checklist: How to Make Your Tracking nFADP-Compliant
- IP Anonymization: In Google Analytics 4 (GA4), anonymization of IP addresses is activated by default. This is a significant advantage over older versions.
- Data Processing Agreement (DPA): In your Google Analytics account, go to Admin > Account Settings and accept the data processing terms.
- Cookie Banner (Consent): Use an "Opt-In" banner. Google Analytics should only collect data after the user has actively clicked "Accept."
- Retention Period: Under Data Settings > Data Retention, set the period to 2 months (default) to comply with the principle of data minimization.
- Privacy Policy: Add a section to your website that explains exactly what data Google Analytics collects and how users can opt-out.
Why the nFADP Matters to Shop Owners
The nFADP demands transparency. Users must know that their data (even if anonymized) is being processed. It is particularly important for Swiss companies to mention that data processing by Google takes place in the USA. This must be explicitly stated in your privacy policy.
Avoiding "Fingerprinting"
Ensure that no personally identifiable information (PII), such as email addresses or names, is transmitted in the URLs of your website that Analytics might capture. Google strictly prohibits this, and it would violate the Swiss nFADP.
